High Court Hears Challenge to Recess Appointments

The U.S. Supreme Court is weighing a challenge to the presidential power to fill high-level positions when the Senate is in recess.

The high court is hearing arguments Monday in a 2-year-old dispute between President Barack Obama and Senate Republicans.

Three federal appeals courts have already said the president over-stepped his authority when he made appointments to the National Labor Relations Board and the Consumer Financial Protection Bureau in January 2012.
 
Recess power allows the president to make appointments that normally require senate confirmation, when the Senate is in recess, but Senate republicans say they were not in recess at that time.
