Court Hears Challenge to Texas Gay Marriage Ban

Texas' voter-approved amendment banning gay marriage is being challenged Wednesday in federal court.

Two gay couples sued, saying the law is unconstitutional and that it discriminates against them. The couples are asking the court to lift the ban.

Texas Attorney General Greg Abbott, who is running for governor, has promised to defend the constitutional amendment defining marriage as being between one man and one woman. The law was approved by voters approved in 2005.

"The attorney general's office will defend the Texas Constitution in this case just as we do in all cases where state laws are challenged in court," Abbott's spokeswoman Lauren Bean said. "The U.S. Supreme Court was clear that states have independent authority to establish their marriage laws."
