Judge: Okla. Gay Marriage Ban Unconstitutional

09-07-2014

A federal court has ruled Oklahoma's gay marriage ban unconstitutional.

U.S. District Judge Terrence Kern handed down the decision Tuesday in a lawsuit filed by two same-sex couples.

The couples sued for the right to marry and to have a marriage from another jurisdiction recognized in their state.

The judge said the state's voter-approved ban on gay marriage violates the Equal Protection clause in the U.S. Constitution.

The ruling comes less than a month after a federal judge in Utah reached the same conclusion.

Meanwhile, More than 30 states have passed amendments or laws restricting marriage to a man and a woman.
