Three Pittsburgh-based transgender students are suing their school district for rejecting President Barack Obama's bathroom mandate.
Jacob Evancho, who now wants to be identified at Juliet, and two other students have sued Pine-Richland School District over its "discriminatory" bathroom policy.
The school district once allowed its students to use any bathroom of their choice, but an August school board resolution changed that. In a 5-4 vote, the school district amended its original policy.
"All students will have the choice of using either the facilities that correspond to their biological sex or unisex facilities. This practice will remain in place until such time that a policy may be developed and approved," the resolution said.
While the school district sees the new policy as a step in the right direction to protect student privacy, the three transgender students see it as an attempt "to erase their identity."
Omar Gonzalez-Pagan, the New York-based attorney who filed the lawsuit, told ABC News the policy is motivated by "misunderstanding, fear and a lack of empathy."
The lawsuit says the bathroom policy violates Title IX and the equal protection clause of the Constitution.
Pine-Richland School District has declined to comment on the pending lawsuit.
